Cleveland Dodd inquest: Senior officer seemingly found ‘napping’ on tragic night excused from giving evidence

The most senior Unit 18 officer who was apparently sleeping when detainee Cleveland Dodd fatally self-harmed has been excused from giving evidence. The first phase of the 16-year-old’s inquest earlier this year was told that the apparently sleeping officer, Kyle Mead-Hunter, had to be roused from a dark room when the alarm was raised — emerging adjusting his clothing. When the probe resumed on Monday, it was revealed that Mr Mead-Hunter, who was set to be the first witness, would not take the stand. The WA Coroner’s Court was previously told he was suffering psychologically and now continued to have symptoms of post-traumatic stress disorder, exacerbated by his looming court date. A psychiatrist concluded he was not fit to attend as he could not tolerate extended periods of questioning. Coroner Phil Urquhart said the court could not compel a witness to give evidence if it would harm them. He said there was one condition: that Mr Mead-Hunter, who has already given evidence to a separate Corruption and Crime Commission inquiry, would have to answer questions in writing. Interested parties — such as Cleveland’s grieving mother, Nadene Dodd, and the Department of Justice — can submit questions through their lawyers that will be vetted by the court. Steven Penglis, acting for Ms Dodd, said it was “putting it lightly” that the family was disappointed, adding he wanted to know more about how the court would decide the questions. Outside court, Cleveland’s grandmother Glenda Mippy said she was “disgusted” Mr Mead-Hunter would not be appearing. “He should be in this courthouse … we wanted to hear from him,” Ms Mippy said. Aboriginal Legal Service director Peter Collins gave evidence on Monday, saying he had sent Deputy Commissioner of Women Christine Ginbey a letter saying being moved from Banksia Hill to the notorious unit within the adult maximum security Casuarina Prison was negatively affecting Cleveland. But he did not receive a response from Ms Ginbey or an explanation for her lack of response. She was previously the Deputy Commissioner for Young People, but the portfolio was split soon after the October tragedy, and her successor only started this month. Mr Collins also said ALSWA no longer held quarterly meetings or meaningful discussions with the department after its Supreme Court case against the government entity. Justice Paul Tottle ruled in 2022 that rolling lockdowns that left detainees languishing in their cells for more than 20 hours per day were unlawful. Former Inspector of Custodial Services Neil Morgan said it should stop happening immediately. “Until that issue is resolved, the department has no governing authority,” Professor Morgan told the court. “Young people are really not getting much out-of-cell time still. “There’s nowhere for them to let off steam. So why should we be surprised when they smash the place up?” He said that when he heard about Unit 18, he feared there would be a suicide. “I was horrified when Cleveland died. Was I surprised? Not at all. “I couldn’t see what the outcome would be other than tragic.” Prof Morgan called for a separate Department of Youth Justice to consider regional juvenile detention models and for Unit 18, which was meant to be a temporary solution for a disruptive cohort, to close. “There has to be a closure date,” Prof Morgan said. “This is just drifting interminably.” Keenly awaited forthcoming witnesses include former department Director-General Adam Tomison, who quit in the wake of Cleveland’s death. Tim Marney, the highly respected public servant whose contract was not renewed six months after he was appointed to implement a new model of care at Banksia Hill, will also give evidence. In bombshell testimony during the first tranche of the inquest, the court was told Cleveland threatened to harm himself eight times on his final, tragic night in the notorious facility when he was denied repeated requests for drinking water. He also asked for paracetamol, but none came. It was also revealed that some of the guards on duty had previously faced disciplinary action, while Mr Mead-Hunter had findings against him for breaching professional standards. The court was told that was over the senior officer spending hours in a darkened room with another guard and on social media. There was also evidence backing up an interim report by the department released in November that guards streamed movies while on duty. Also, youth custodial officers weren’t wearing their radios that night, and the guard who found the teen hanging from a broken vent, Daniel Torrijos, did not run for help, testifying that he had knee arthritis. Toilet paper that Cleveland had used to cover his in-cell camera was not removed, so he was not being visually observed. The interim report revealed that cell check records for the boy that night were ticked from 7.15pm through to 6am, even though he was rushed to hospital around 2.30am. That “suggested the form was pre-populated in advance by YCOs on duty”, the report read.
