Unhappy with the taste of a tomato, a Manjimup man tossed it out the window of a moving car — smashing the windscreen of an oncoming vehicle. Rastus Herdigan, 19, faced the Manjimup Magistrates Court on Thursday where he pleaded guilty to a charge of damaging property. The court was told that at 4.30pm on March 6 Herdigan was a passenger in a vehicle driving northbound on South Western Highway when, after picking up a box of tomatoes from a roadside stall, he threw a tomato out of his window which hit an incoming car. The impact caused $840 worth of damage to the car’s windscreen. The court heard his “beef” was the poor quality of the tomato and that Herdigan had no intention of hitting or damaging any vehicle, with him quoted as having said, “The tomato tasted like s ..., so I threw it out of the window”. Magistrate Benjamin Tyers noted a previous offence of damage, and issued a $300 fine, $264.30 in court costs and an order to compensate the owner of the damaged vehicle.
